(JEFFERSON CITY, Mo.) Mark Woodworth was released from state custody into the custody of the Livingston County Sheriff's Office Thursday.

As per a court mandate released Thursday, Woodworth remains in the custody of the sheriff until the circuit court determines his release.

The court recently overturned  a conviction against Woodworth in the 1990 shooting death of his neighbor.

An opinion issued on the court's decision to overturn the conviction said the state intended to retry the case.
